Welcome to RUZE.

These Terms of Service ("Terms") apply when you visit ruze.com.au, purchase products from us or otherwise use our website.

Throughout these Terms, "RUZE", "Ruze Apparel", "we", "us" and "our" refer to Ruze Apparel.

By using our website or placing an order with us, you agree to these Terms.

Please read them together with our Privacy Policy, Shipping Policy and Returns Policy.

1. About RUZE

RUZE is an Australian apparel brand selling clothing and related products through our online store.

Our website is hosted by Shopify, which provides the ecommerce platform that allows us to sell our products online.

2. Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any right, guarantee or remedy that you have under the Australian Consumer Law or any other applicable law where that right cannot lawfully be excluded.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.

You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Any returns, exchanges or other benefits offered by RUZE are in addition to your rights under Australian Consumer Law.

3. Using our website

You may use our website for lawful personal and commercial shopping purposes.

You must not use the website:

  • for unlawful, fraudulent or abusive purposes

  • to interfere with the operation or security of the website

  • to introduce malicious code, viruses or other harmful material

  • to attempt to gain unauthorised access to our systems

  • to copy, scrape or exploit website content in a way that infringes our rights or the rights of others

  • to impersonate another person or provide deliberately false information

We may restrict or terminate access to the website where we reasonably believe it is being misused.

4. Product information

We aim to describe our products accurately, including their:

  • sizing

  • fit

  • fabric

  • colour

  • print

  • construction

  • product features

However, colours may appear slightly different depending on your screen, lighting conditions or device.

Garment measurements may also vary slightly due to normal manufacturing tolerances.

Product images are intended to represent the product as accurately as reasonably possible, but minor differences may occur between images and the final physical product.

Nothing in this section limits your rights under Australian Consumer Law if a product is faulty, materially different from its description or otherwise fails to meet a consumer guarantee.

5. Sizing and fit

We provide sizing and garment information to help customers select an appropriate size.

Fit preferences differ between customers, so we encourage you to review the relevant size guide and garment measurements before ordering.

Where we provide model measurements or sizing information, this is intended as a guide only.

Choosing the wrong size does not affect any rights you may have if the product itself is faulty or does not meet a consumer guarantee.

Any additional change-of-mind size exchanges are subject to our Returns Policy.

6. Orders

When you place an order, you are making an offer to purchase the products in that order.

You will receive an order confirmation after your order is submitted.

An automated order confirmation does not necessarily mean that we have accepted your order.

We may refuse or cancel an order where reasonably necessary, including where:

  • a product is unavailable

  • incorrect pricing or product information has been published

  • payment cannot be authorised

  • we reasonably suspect fraud or unauthorised activity

  • there has been an obvious technical or system error

If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled item or order.

7. Product availability

Products and sizes are subject to availability.

We may change, discontinue or temporarily remove products, sizes or colours at any time.

In rare circumstances, a product may become unavailable after you place an order.

If we are unable to supply an item you have paid for, we will contact you and provide an appropriate solution, which may include a refund, replacement or other remedy where applicable.

8. Pricing

Unless otherwise stated, prices displayed on our Australian website are shown in Australian dollars (AUD).

Prices include applicable taxes where required by law.

Shipping charges, where applicable, are shown before you complete checkout.

We may change our prices at any time.

A price change will not affect an order that has already been accepted, except where there has been an obvious pricing error and applicable law permits us to correct it.

We do not deliberately advertise one price and charge another.

9. Payment

Payment must be made using a payment method available at checkout.

Payments are processed through Shopify and/or relevant third-party payment providers.

RUZE does not generally receive or store your complete payment card details.

Your use of a third-party payment service may also be subject to that provider's terms and conditions.

We may delay or cancel an order where payment cannot be verified or where we reasonably suspect fraudulent activity.

10. Printing and fulfilment

RUZE works with third-party printing and fulfilment providers to produce and dispatch some or all of our products.

As a result, orders may be produced or dispatched from a facility operated by one of our fulfilment partners.

The use of third-party fulfilment providers does not remove any rights you have against RUZE under applicable Australian consumer law.

RUZE remains your point of contact if there is a problem with your order.

11. Shipping and delivery

Shipping options, estimated delivery timeframes and applicable charges are provided on our website or at checkout.

Delivery timeframes are estimates rather than guaranteed delivery dates unless we specifically state otherwise.

Delivery may occasionally be affected by circumstances outside our reasonable control, including:

  • courier delays

  • severe weather

  • public holidays

  • high-volume periods

  • supply interruptions

  • incorrect delivery information provided by the customer

If you believe an order has been lost, damaged or significantly delayed, please contact us so we can investigate and provide an appropriate solution.

If we cannot supply your order within a reasonable time, you may be entitled to a refund, replacement or another remedy under Australian Consumer Law.

Customers are responsible for providing a complete and accurate delivery address.

If an order cannot be delivered because incorrect or incomplete information was supplied, additional delivery costs may apply where permitted by law.

12. Returns, exchanges and refunds

Returns and exchanges are governed by our Returns Policy.

Our voluntary change-of-mind or exchange policy operates in addition to your rights under Australian Consumer Law.

Nothing in our Returns Policy or these Terms prevents you from seeking a remedy where a product:

  • is faulty

  • is unsafe

  • does not match its description

  • is materially different from what was ordered

  • is not of acceptable quality

  • otherwise fails to meet an applicable consumer guarantee

Depending on the circumstances and applicable law, available remedies may include repair, replacement, refund or compensation.

Proof of purchase may be required to process a return or consumer guarantee claim.

13. Change-of-mind purchases

Where RUZE offers returns or exchanges for change of mind, those returns are subject to the conditions set out in our Returns Policy.

Change-of-mind rights offered by RUZE are separate from your legal rights where a product is faulty or fails to meet a consumer guarantee.

We may reasonably require returned change-of-mind items to be:

  • unworn

  • unwashed

  • unused

  • in their original condition

  • returned within the applicable returns period

These requirements do not apply where they would unlawfully restrict your rights under Australian Consumer Law.

14. Promotions and discount codes

Promotional offers and discount codes may have their own conditions, including:

  • validity periods

  • minimum order values

  • product exclusions

  • single-use limits

  • customer eligibility requirements

Unless otherwise stated, promotions cannot be combined.

We may cancel or refuse a promotion where there has been an obvious error, misuse, fraud or breach of the promotion conditions.

Promotions do not affect your rights under Australian Consumer Law.

15. Gift cards

If RUZE offers gift cards, store credits or similar products, additional terms may apply.

Any expiry periods will comply with applicable Australian law.

Gift cards and store credit are not intended to replace a refund or other remedy that you are legally entitled to receive under Australian Consumer Law.

16. Intellectual property

Unless otherwise stated, the content available through RUZE, including:

  • RUZE branding

  • logos

  • product graphics

  • artwork

  • photographs

  • website design

  • written content

  • product descriptions

  • marketing materials

is owned by RUZE, licensed to RUZE or otherwise used with permission.

This content is protected by applicable Australian and international intellectual property laws.

You may view and use our website for ordinary personal shopping purposes.

You must not reproduce, distribute, sell, modify or commercially exploit our content without permission unless you are otherwise legally entitled to do so.

Third-party names, trademarks and intellectual property remain the property of their respective owners.

17. Customer-submitted content

If you send us reviews, photographs, feedback or other content, you remain responsible for ensuring that you have the right to provide that content.

We will not claim ownership of your personal photographs or original content merely because you submit them to us.

If you expressly provide content for us to publish, repost or use in connection with RUZE marketing, you grant us a non-exclusive permission to use that content for the purpose you authorised.

We will not knowingly use customer content in paid advertising without appropriate permission.

18. Reviews

We may allow customers to submit product reviews or feedback.

Reviews must reflect genuine experiences and must not contain unlawful, abusive, misleading, defamatory or fraudulent material.

We may remove content where reasonably necessary to protect customers, comply with the law or maintain the integrity of our website.

We will not create or publish fake customer reviews or deliberately alter reviews in a way that misrepresents customer feedback.

19. Third-party services and links

Our website may contain services, applications or links provided by third parties, including Shopify, payment providers, social media platforms and other service providers.

Those third parties may have their own terms and privacy policies.

We are not responsible for the content or practices of third-party websites that are outside RUZE's control.

20. Website availability

We aim to keep our website accurate, secure and available.

However, we do not guarantee that the website will always operate without interruptions, delays or technical errors.

We may temporarily suspend or modify parts of the website for maintenance, security, upgrades or other operational reasons.

Nothing in this section excludes liability that cannot legally be excluded.

21. Liability

To the maximum extent permitted by law, RUZE is not responsible for indirect or consequential losses arising solely from circumstances outside our reasonable control.

However, nothing in these Terms excludes, restricts or modifies any liability, consumer guarantee, right or remedy that cannot lawfully be excluded under Australian Consumer Law or other applicable legislation.

Where the law allows liability to be limited, any limitation will only apply to the extent legally permitted.

22. Indemnity

You are responsible for losses reasonably suffered by RUZE as a direct result of your unlawful use of our website or deliberate infringement of our rights.

This section does not require you to compensate RUZE for losses caused by RUZE's own negligence, breach of law or wrongful conduct.

23. Privacy

Our collection and handling of personal information is explained in our Privacy Policy.

By using our website, you acknowledge that information may be handled in accordance with that policy and applicable privacy laws.

24. Changes to these Terms

We may update these Terms from time to time to reflect changes to:

  • our products

  • our service providers

  • applicable laws

  • operational requirements

Updated Terms will be published on our website with a revised "Last updated" date.

Changes will generally apply from the date they are published and will not retrospectively remove rights relating to orders already placed.

25. Severability

If any part of these Terms is found to be unlawful, invalid or unenforceable, that part will be interpreted or removed to the minimum extent necessary.

The remaining provisions will continue to apply.

26. No waiver

If we do not immediately enforce a provision of these Terms, this does not mean we have permanently waived our right to enforce it.

27. Governing law

These Terms are governed by the laws of Victoria, Australia, and applicable Commonwealth laws of Australia.

You and RUZE submit to the jurisdiction of the courts and tribunals of Victoria and Australia where applicable.

Nothing in this section limits any right you may have to bring a claim in another jurisdiction where applicable law gives you that right.
